DESCRIPTION: Mr. Garcia, who was an undocumented worker, was working for a subcontractor on a construction site in Fort Smith, Arkansas. While being raised up to a third story on a makeshift wooden box raised by a fork lift, the box came off the forks, causing Mr. Garcia to be thrown three stories to the ground, ultimately resulting in his death.
